General Terms and Conditions

Article 1 General

1.1 These general terms and conditions are used by HBMEO BV (hereinafter also referred to as: “HOTELNACHT”) and/or by one or more of its subsidiaries and/or affiliated companies. HOTELNACHT is the ‘user’ of these general terms and conditions as defined in Article 6:231 subsection b of the Dutch Civil Code.
1.2 HOTELNACHT is located at Vijzelstraat 68 (1017 HL) in Amsterdam and can be reached via email at info@hotelnacht.nl. HOTELNACHT is registered with the Amsterdam Chamber of Commerce under number 27188914.
1.3 These general terms and conditions apply exclusively to individuals and expressly not to parties acting in their capacity as professional contractual parties in relation to HOTELNACHT. Different terms and conditions apply to legal relationships between HOTELNACHT and professional contractual parties.
1.4 The ‘counterparty’ referred to in these terms and conditions is the individual visitor of an event, website, or app of HOTELNACHT, hereinafter referred to as the ‘visitor.’

Article 2 General Terms and Conditions

2.1 These general terms and conditions apply to all admission tickets and form an inseparable part of all agreements concerning the purchase, gifting, and delivery of tickets for HOTELNACHT events, regardless of where they are held. They also apply to any legal relationship between HOTELNACHT and the visitor, including website or app visits.
2.2 By purchasing, receiving, or using a ticket and/or entering the event location and/or reading these terms via HOTELNACHT ticket shops, the visitor accepts the content of these terms. This applies even if the ticket was obtained via third parties.

Article 3 Admission Ticket

3.1 Access to a HOTELNACHT event is only granted upon presentation of a valid admission ticket.
3.2 Access is granted only to persons aged 18 and older unless explicitly stated otherwise on the event’s website. Visitors may be asked for ID to verify age. If valid ID is not presented or the age requirement is not met, access will be denied, and HOTELNACHT will not be obligated to refund the ticket price.
3.3 Admission tickets remain the property of HOTELNACHT. Visitors are prohibited from reselling tickets or offering them for sale for commercial purposes. In case of violations, HOTELNACHT reserves the right to deny access and claim damages.
3.4 HOTELNACHT may invalidate tickets or deny access in case of violations of these terms without refunding the ticket price. Invalidated tickets are not eligible for refunds or compensation.
3.5 Visitors are prohibited from advertising or promoting the event in any way that infringes on HOTELNACHT’s trademark rights.
3.6 Non-compliance with these terms may result in a fine of €5,000 per violation and €500 per day the violation continues, without prejudice to HOTELNACHT’s right to claim further damages.
3.7 Tickets purchased via third-party platforms are subject to additional terms imposed by those platforms alongside HOTELNACHT’s terms.

Article 4 Denial of Access

HOTELNACHT reserves the right to deny access to specific visitors or remove them from the event to maintain public order and safety.

Article 5 Film and Video Recordings

Visitors are prohibited from recording the event without prior written consent from HOTELNACHT, except for personal use (e.g., smartphone photos or videos). Commercial use of such materials is strictly prohibited.

Article 6 Personal Risk

Visitors enter the event venue and attend at their own risk. HOTELNACHT’s liability is limited to the amount paid out by its insurance in cases of personal injury or costs, except in cases of gross negligence or willful misconduct by HOTELNACHT management.

Article 7 Program

HOTELNACHT strives to execute the event program as announced but is not liable for deviations or resulting damages. HOTELNACHT is also not responsible for the content, execution, or length of the program.

Article 8 Additional Rules

8.1 Visitors must adhere to rules and instructions from HOTELNACHT, venue staff, security personnel, or authorities.
8.2 Violations of these rules may result in immediate removal from the event without refund.

Article 9 Force Majeure

9.1 In cases of force majeure (e.g., illness, strikes, equipment failure, weather conditions, pandemics), HOTELNACHT may evacuate, reschedule, or cancel the event without compensation.
9.2 Only in cases of cancellation not caused by force majeure will HOTELNACHT refund the ticket price, excluding booking fees.
9.3 Refunds will be processed within a reasonable timeframe upon presentation of a valid ticket.

Article 10 Event Recordings

HOTELNACHT is entitled to record and distribute event footage, including visitors, for any purpose without compensation.

Article 11 Smoke-Free Events

Smoking is prohibited at indoor HOTELNACHT events except in designated areas. Violators will be fined according to venue policies.

Article 12 Applicable Law and Jurisdiction

Dutch law applies to these terms, and the Amsterdam District Court has exclusive jurisdiction over disputes.
